OUR COMMITMENT TO PRIVACY

This Privacy Policy explains what personal and other information about you is collected by Joust Labs, Inc. (referred to collectively herein as “Joust,” “We,” “Us,” or “Our”) through our websites (the “Site”) and mobile applications (“Mobile App”), and how we use and share that information offered through Joust Services (the “Services”). As used in this Privacy Policy the term “Joust Platform” or “Platform” includes: the Website, the Mobile App, and all devices or applications operated by Joust that collect personal information from you and that link to this Privacy Policy; pages within each such website, device, or application, any equivalent, mirror, replacement, substitute, or backup website, device, or application; and pages that are associated with each such website, device, or application.

This Privacy Policy is available from our home page of the Website and through the Mobile App. You may also email us at joust@zenbusiness.comwith any privacy-related questions you have.

APPLICABILITY OF PRIVACY POLICY

This Privacy Policy applies to all information we collect through the Joust Platform from Joust users, including you. The term "personal information" means information associated with a specific person and can be used to identify that person. We do not consider personal information to include information that has been anonymized so that it does not identify a specific user.

By visiting the Platform and/or using Joust, you agree to be bound by this Privacy Policy and our Terms and Conditions. If you do not agree to any of the terms in this Privacy Policy, you may not access or use the Platform and/or the Services. Further, by signing up, accessing, and/or using our Services, you explicitly agree to the terms of this Privacy Policy, our Terms and Conditions, and any applicable customer agreements separately agreed by you from time to time in connection with your use of the Platform and/or Services.

THE INFORMATION WE COLLECT

When you visit the Platform, we collect your IP address, and standard web log information, such as your browser type and the pages you accessed on our Platform. We also may collect certain geo-location information. If you do not agree to our collection of this information, you may not be able to use our Services.

If you open an account, we collect the following information from you:

  • Account Information - text-enabled cellular/wireless telephone number, machine or mobile device ID and other similar information.
  • Identification Information - your name, email address, date of birth, and social security number (or other applicable government identification numbers).
  • Device Information - device MAC address and other device identification data.
  • Financial Information - bank account, routing numbers and credit cards linked to your Joust account. Joust does not share financial information with any third-party social networking services.
  • Social Media Information - including but not limited to your Facebook Connect credentials and email account information. If you authorize Facebook Connect, this Facebook service allows us access to your contact information of your Facebook friends. We also allow you to import data from other social web services, including but not limited to LinkedIn, and email service providers. Social and email contact information helps you connect to friends and contacts for invitation and payment transmission purposes (as well as helping us improve our services and fight fraud). Additionally, another Joust user may mention you in a transaction in which you are not a party to by “tagging” your username in a transaction note. When you are mentioned in a transaction, a link to your Joust profile will appear in the transaction note and you will receive a notification about the mentions. You may manage certain contact preferences and notifications in your account settings.
  • In addition to the above we may also may obtain information about you: (a) from your mobile device such as your device type, machine or mobile device identification number, geo-location, time zone, language settings, browser type, and IP address, and (b) from third parties for purposes of transaction processing, identity verification, fraud detection or prevention and other similar purposes.

We may require additional information from you to verify your identity, physical address, or other information or to manage risk and compliance throughout our relationship. We may also obtain information about you from third parties such as identity verification, fraud prevention and similar service providers.

When you are using the Joust Platform, we collect information about your account transactions and we may collect information about your computer or other access device for fraud prevention and other similar purposes.

Finally, we may collect additional information from or about you in other ways not specifically described here. For example, we may collect information related to your contacts with our customer support team or store results when you respond to a survey from us.

INFORMATION FROM MINORS

We do not knowingly solicit or collect information from any individuals under the age of 18. No one under the age of 18 is authorized to be a user of the Joust Platform or have access to the applications. If you believe that a minor in your care has provided us with information, please contact us at joust@zenbusiness.com.

HOW WE USE COOKIES

When you access the Platform, we, or companies we hire to track how our Platform is used, may place small data files called "cookies" on your computer. For example, we send a "session cookie" to your computer any time you log in to your Joust Account. This type of cookie helps us to recognize you if you visit multiple pages on our site during the same session, so that we don't need to ask you for your password on each page. You are free to decline Joust cookies if your browser permits, but doing so may interfere with your use of the Platform.

HOW WE PROTECT AND STORE PERSONAL INFORMATION

We store and process your personal information using third party servers located in secure data centers in the United States. This information is protected by physical, electronic and procedural safeguards in compliance with applicable U.S. federal and state regulations. We also use computer safeguards such as firewalls and data encryption, enforce physical access controls to our office and files, and authorize access to personal information only for those employees who require it to fulfill their job responsibilities.

We utilize commercially reasonable physical, technical, and administrative security measures to help protect information under Joust’s control against loss, misuse, and alteration. For example, we use a combination of firewall barriers, encryption techniques and authentication procedures, among others, to maintain the security of your online session, your personal information and to protect Joust accounts and systems from unauthorized access. Despite our efforts, we cannot guarantee that personal information may not be accessed, disclosed, altered or destroyed by breach of our administrative, managerial and technical safeguards. We urge you to take adequate precautions to protect your personal data as well, including never sharing your Joust password with anyone.

HOW WE USE THE PERSONAL INFORMATION WE COLLECT

We may use your personal information to:

  • Provide the Services and customer support you request.
  • Process transactions and send notices about your transactions or your network activity.
  • Resolve disputes, collect fees, and troubleshoot problems.
  • Prevent potentially fraudulent, prohibited or illegal activities, and enforce our Terms and Conditions.
  • Customize, personalize, measure, and improve our services and the content and layout of our website.
  • Send you updates about new products and services that we are offering to customers.
  • Compare information for accuracy and verify it with third parties.
  • Take any actions or perform any other duties required by law.

HOW WE SHARE PERSONAL INFORMATION WITHIN THE JOUST NETWORK

To facilitate payments via the Joust Platform, we need to share some of your personal information with other persons or companies. Your name, contact information, address, date of sign-up, the number of payments you have received and other verification metrics, like social graph activity, may be provided to persons or companies when you transact with, on, or through the Joust Platform.

We work with vendors to enable them to accept payments from you using the Joust Platform. In doing so, a vendor may share information about you with us, such as your mobile phone number or Joust username, when you attempt to pay that vendor. We use this information to confirm to that vendor that you are a Joust User and that the vendor should accept payment for your purchase.

Regardless, we will not disclose your credit card number or bank account number to anyone you have paid through the Joust Platform, except with your express permission or if we are required to do so to comply with a court order or other legal process.

HOW WE SHARE PERSONAL INFORMATION WITH OTHER PARTIES

Joust does not share your personal information with third parties for promotional or marketing purposes.

We may share your personal information with:

  • Our affiliates and subsidiaries we control, but only for purposes allowed by this document.
  • Companies we plan to merge with or be acquired by or, in the event of any bankruptcy, a bankruptcy estate. Should such a combination occur, we will request that the new combined entity follow this Privacy Policy with respect to your personal information. If this Privacy Policy will be amended in connection with such a combination, you will receive prior notice and the opportunity to communicate preferences you may have, if applicable.
  • Law enforcement, government officials, or other third parties when compelled to do so by a court order, subpoena or similar legal procedure, when it is necessary to do so to comply with law, or where the disclosure of personal information is reasonably necessary to prevent physical harm or financial loss, to report suspected illegal activity, or to investigate violations of the Joust Terms and Conditions, or as otherwise required by law.
  • Third party service providers who assist us in providing Services to you, including, but not limited to, those who provide fraud detection or similar services on our or any vendor's behalf.
  • Service providers under contract who assist with our business operations (for example, fraud prevention, payment facilitation, or technology services).
  • Other third parties with your consent or at your direction to do so.

WE MAY USE THIRD PARTY PROVIDERS TO TARGET ONLINE ADVERTISING

We may also use contracted third-party service providers to help us analyze certain online activities. For example, these service providers may help us measure the performance of our online campaigns or analyze visitor activity. We may permit these service providers to use cookies and other technologies to perform these services for us.

The Platform and Services also enable authorized third-party tracking mechanisms for use in online behavioral advertising.

For example, authorized third parties may use the fact that you used the Joust Platform to target online ads for Joust services to you on non-Joust websites. In addition, our third-party advertising networks might use information about your use of the Services to help target non-Joust advertisements based on your online behavior. For information about behavioral advertising practices, including privacy and confidentiality, visit the Network Advertising Initiative website or the Digital Advertising Alliance website.

DO NOT TRACK DISCLOSURE AND RELATED OPTIONS.

The Joust Platform currently does not respond to “do not track” browser headers. However, you can limit tracking through these third-party programs and by taking the following steps. The use of online tracking mechanisms by third parties is subject to those third parties’ own privacy policies, and not this Privacy Policy. If you prefer to prevent third parties from setting and accessing cookies on your computer, you may set your browser to block cookies. Additionally, you may remove yourself from the targeted advertising of companies within the Network Advertising Initiative by opting out here, or of companies participating in the Digital Advertising Alliance program by opting out here.

THIRD PARTY SERVICES AND CONTENT

Your use of the Joust Platform and Services confirms acceptance of Plaid’s Privacy Policy. Plaid is a third-party service provider to Joust that facilitates the transfer of your personal information to and from financial institutions. In using the Joust Platform and Services you expressly authorize and grant to Plaid the right, power and authority to act on your behalf to access and transmit your information as reasonably necessary for Plaid to provide services to you on Joust's behalf.

If you choose to sign up for the Joust Visa Debit Card, you understand that such card is issued by nbkc bank and you confirm acceptance of nbkc bank's privacy practices which you can download here.

If you choose to sign up for Joust's PayArmour invoicing service, you understand that the ability to facilitate ACH transactions in connection with the PayArmour service is provided by Dwolla, Inc. If you sign up for PayAmour, you hereby authorize Joust to collect and share with our payments provider, Dwolla, Inc., your personal information including full name, date of birth, social security number (or other applicable government identification number), physical address, email address and financial information, and you are responsible for the accuracy and completeness of that data. Joust's PayArmour service also allows you to accept debit and credit card payments. This service is provided by our third-party partner, ProPay, Inc., and in doing so, you hereby confirm acceptance of ProPay's ProFac Sub-Merchant Terms and Conditions.

The Platform and Services contain comment fields and other features that permit you to share information publicly. The Platform and Services also may enable you to share personal information with third-party websites or online services operated by third parties. For example, the Platform contains links and widgets for third party websites that incorporate comments and social media features. If you choose to use these features, you may disclose your personal information not just to those third-party websites and services, but also to their users and the public more generally. Because these third-party websites and services are not operated by Joust, we are not responsible for the content or practices of those websites or services. The collection, use, and disclosure of your personal and non-personal information on those websites and applications will be subject to the privacy policies of the third-party websites or applications, and not this Joust Privacy Policy.

The Services also integrate certain third-party plug-ins (such as a Facebook “like” button). Even if you do not click on these plug-ins, they may collect information about you, such as your IP address and the pages that you view. They also may set and/or access a cookie. These plugins are governed by the privacy policy of the company providing them.

HOW YOU CAN ACCESS OR CHANGE YOUR PERSONAL INFORMATION

You can review and update your personal information in your account settings at any time by logging in to your account. It is your responsibility to keep your personal information up to date by updating your profile in the mobile application or by contacting our Customer Support team at joust@zenbusiness.com. We are not responsible for costs or other issues arising from your failure to keep your personal information up to date.

We recommend that you change your password periodically or any time you have reason to believe your credentials may be compromised. You are responsible for maintaining the security of your Login ID and Password. You may not provide these credentials to any third party. If you believe that they have been stolen or been made known to others, you must contact us immediately at joust@zenbusiness.com, but in any event you should change your password immediately via the Platform. You also agree that you control and limit access to your email account and mobile device. If your email address changes, you are responsible for informing us of that change. We are not responsible if someone else accesses your account through registration information they have obtained from you or your violation of this Privacy Policy or the Terms and Conditions.

You may request that we delete your Joust Account. To request deletion of your account, email joust@zenbusiness.com, requesting a deletion of your Account. Merely deleting the Mobile App from your device does not constitute a request to delete your account. Once your request to delete your account has been processed, we will promptly disconnect any connection we may have established to your Account Information (as defined in the Terms and Conditions) and delete all External Bank Account credentials in our possession. Notwithstanding the above, we may need to retain your data beyond your account deletion date if required to do so by federal, state or local law.

LINKS TO OTHER SITES

The Platform may contain links to other sites. Joust does not control the information collection of sites that can be reached through links from the Platform. We encourage our users to be aware when they are leaving the Platform and to read the privacy policies of any website that collects personally identifiable information.

CHANGES TO OUR PRIVACY POLICY

We may update this Privacy Policy from time to time. If we modify this Privacy Policy, we will post the revised Privacy Policy to the website, and we will also revise the "effective date" stated above. If we make material changes in the way we use personal information, we will notify you by posting an announcement on our service or by sending you an email. You agree to accept electronic communications and/or postings of revised versions of this Privacy Policy on the Platform and agree that such electronic communications or postings constitute notice to you of the revised version of this Privacy Policy. It is your responsibility to periodically review this Privacy Policy; users are bound by any changes to the Privacy Policy by using the Platform or Services after such changes have been first posted.
